Bert Hertzog charged with trying to ‘escape taxation’

Bert Hertzog of Winsted was once again the center of attention, in a legal sense, as two more charges were leveled against him last week pertaining to his ownership of a Mercedes.

Hertzog was charged with two counts – one gross misdemeanor intent to escape taxation and a misdemeanor vehicle registration infraction related to a 2007 Mercedes SL600. “The paperwork didn’t add up right,” commented Liet. Dan Anselment of the Wright County Sheriff’s Office.

The vehicle was obtained by Hertzog via a Minnetonka dealer, who in turn bought it from Germany.

Hertzog’s first court appearance on these charges will be 9 a.m. Tuesday, July 29 at district court in Buffalo.

His last court date was Friday, pertaining to more serious, but unrelated, charges of Hertzog allegedly issuing fake inspection stickers to commercial vehicles even though he wasn’t licensed to do so.

Hertog’s attorney, Thomas Shiah of Minneapolis, argued that since Hertzog made his inspections remotely – that is, at different locations where he would drive to – the search warrants of Hertzog’s vehicle and house were in admissible because it wasn’t the actual scene of the offenses committed. The judge did not accept this and the search warrant stands.

The searches made last June were where authorities found unauthorized vehicle inspection stickers, as well as a letter that informed Hertzog that his inspector certification was suspended — something that Hertzog said he was unaware of.

An initial investigation done by the State Patrol showed Hertzog did commercial vehicle inspections in 2006 and 2007. Hertzog issued vehicle inspection reports to owners and inspection decals, according to a formal complaint. The decal numbers issued with inspections were recorded and tracked. The decals appeared to be fake, because the actual decals were issued to other people by legitimate certified inspectors, according to the complaint.

Hertzog is charged in Wright County with theft-by-swindle (a felony), aggravated forgery, (a felony) and inspecting vehicles without certification.
His next court appearance for the fraud related charges is set for Tuesday, Aug. 5.

Wright Co. Rd. 6 to be closed for two days

For two days, Wright County Road 6 will be closed approximately 700 feet south of Jeffery Avenue SW in Howard Lake, in order to do replacement of a culvert under the highway, Monday, June 30 and Tuesday, July 1.

A detour will be posted and in effect for those two days.  The closing will begin at approximately 7 a.m. Monday and end at 4 p.m. on Tuesday, weather permitting, according to The Wright County Highway Department.  The Wright County Highway Department asks your cooperation in this matter to ensure the safety of both the traveling public and their maintenance crew.

Watertown man found in the Crow River

A Watertown man, Richard Allen Johnson, 59, was reported missing from his home Monday morning, according to Carver County Sheriff Bud Olson.  He was later found Tuesday deceased in the Crow River at about 7:45 p.m.

Just prior, Johnson, who lives on Riverside Terrace in Watertown, was visiting relatives in the Virginia, Minn. He left Hibbing early Saturday morning, June 21, and his pickup was observed parked in his driveway by neighbors in Watertown at around 9 a.m. that morning. No one saw Johnson since he returned to Watertown and his whereabouts were not unknown. The search has intensified since he failed to show up for work on Monday morning.

Lester Prairie to conduct bloodmobile Wed.

The Red Cross Bloodmobile will be in Lester Prairie Wednesday, June 18 from 1 to 7 p.m. at the city hall.

Looking for nominations in Waverly

The Waverly Ambassador Committee is accepting nominations for the Waverly Volunteer(s) of the Year.  Deadline for nominations is June 15.  Nominations must be a Waverly area resident and have volunteered services for the benefit of the Waverly area community and/or its citizens.

Think of the person/persons who gave of themselves continuously, unselfishly, unnoticed, without expecting anything in return.  It may go back years.  This is the person who we, and the community would like to say “Thank You” for all that you have contributed to our community by awarding to the chosen person, the Volunteer of the Year award.

The letter should include: A brief statement as to why this person     should be Waverly Volunteer of the Year, the name of nominee, areas of volunteer service and number of years involved.   Also include the name of the person(s) or organization submitting the nomination.

HLWW student killed in car accident Wednesday near Annandale

UPDATED SUNDAY AT 9:30 P.M.

A severe car accident took place Wednesday – just days before graduation for HLWW – with four Howard Lake-Waverly-Winsted seniors involved, as they returned from the section track meet on Highway 55 near Annandale.

Killed was HLWW senior Madey Kleve, 18 who was one of three candidates for Miss Howard Lake this year.

Among the injured are senior Kacie Carlsted, 18, who is a prolific dancer and also a candidate for Miss Howard Lake, who has a broken pelvis, punctured lung and facial injuries; senior Mitch Bayerl, 18, who was airlifted to Hennepin County Medical Center, and Brie Barfknecht of Waverly, who was taken to Buffalo Hospital, treated and released. Heroin lands New Germany man in jail

A routine traffic stop in Lester Prairie early Tuesday morning led to a trip to the McLeod County jail for Lance Allen Beckman, 19, of New Germany. Beckman was charged with several offenses including felony possession of heroin, according to a formal complaint.
At approximately 12:30 a.m., Lester Prairie Police Officer Brenda Conzet stopped Beckman for speeding, and for no vehicle registration.
Beckman was only able to provide a photo copy of his driver’s license, and told Conzet that he had sent his license to the social security office to obtain a new card. His social security card was located in his wallet during the investigation, according to the complaint.

Suspect is captured in Winsted

A suspect was captured in Winsted today  who was involved in a Watertown Township shooting early this morning, according to Carver County Sheriff Bud Olson. Winsted Police Chief Mike Henrich noticed the vehicle in the cemetery and checked it out — finding the suspect asleep in his car.  Ryan Lindeen, 44, (unknown address) was arrested without incident after allegedly shooting a female in the arm and leg with a .22 caliber rifle after a struggle. Lindeen’s car was towed from the Holy Trinity cemetery in Winsted this afternoon at about 4 p.m.

Hertzog’s attorney challenges search warrant

On Monday (April 28), the attorney for Bert Hertzog of Winsted challenged the probable cause for a search warrant executed at Hertzog’s residence last June, which resulted in charges of  inspection of commercial vehicles without certification, theft-by-swindle, and aggravated forgery.

Attorney Thomas Shiah of Minneapolis presented the challenge to the probable cause that led to the search last summer.  The search recovered unauthorized vehicle inspection stickers, as well as a letter that informed Hertzog that his inspector certification was suspended — something that Hertzog said he was unaware of.

The charges stem from Hertzog allegedly issuing fake inspection stickers to commercial vehicles even though he wasn’t licensed to do so.

The judge will take the matter under advisement and issue a decision after May 16, commented Assistant County Attorney Brian Lutes.  Both sides of the case submitted their legal arguments, and the judge will weigh both.
