Carver County public hearing: feedlot management

NOTICE IS HEREBY GIVEN that the regularly scheduled Carver County Planning Commission meeting to be held on Tuesday, the 21st day of June 2022, as soon as possible after 7:00 p.m. upstairs in the Human Services Bldg (602) in the Commissioner’s Meeting Room of the Carver County Government Center, Chaska, Minnesota, the Carver County Planning Commission will hold a public hearing to: Approve Ordinance 101-2022, amending the Carver County Code of Ordinances, Chapter 54 – Feedlot Management. All persons having an interest in the matter and wish to provide written public comments related to the meeting can do so by mail or by visiting: and searching “feedlot ordinance”. Written comments received by 12:00 PM (noon) Friday, June 3, 2022, will be part of the public record and will be available for review by the Planning Commission prior to the meeting.
PURPOSE: To allow the Planning Commission to hold a public hearing to consider various language amendments to the Carver County Code Ordinances, Chapter 54 (Feedlot Management). Proposed amendments are consistent with Minnesota Rules Chapter 7020, Animal Feedlots.
PROPOSED ADOPTIONS: The proposed text amendment includes additions of numerous definitions, setback and location requirements, and other minor modifications to be consistent with Minnesota Rules Chapter 7020 and the Carver County Zoning Code. Tables identifying animal unit calculations and manure application setbacks have been included as well. The proposed amendments also include the additions of the following sections from Minnesota Rules Chapter 7020; Construction Short-Form Permits and Interim Permits (§ 54.32), Feedlot Registration (§ 54.33), Short-term Manure Stockpiling Sites (§ 54.61), and Animal Feedlot or Manure Storage Area Closure (§ 54.65).
PROPOSED REPEALS: Several definitions are described in § 54.04, but they are not used in the County Feedlot Management Ordinance. The proposed amendment also eliminates § 54.33, Education, and § 54.62, Steel Manure Holding Tanks.
PROPOSED CHANGES: The definition of a “New Animal Feedlot” has been modified to match Minnesota Rules Chapter 7020.0300. The setback for a manure stockpile has been increased from 200 feet to 300 feet from residences, churches, schools, regional parks, cemeteries, non-agricultural commercial activities, and restaurants. § 54.19, Appeals, has been updated to match the County Zoning Code and § 54.63, Commercial Manure Pumpers and Applicators, has been modified to accurately reflect registration requirements.
